Why are there lawsuits against Monsanto?
The lawsuit alleges that Monsanto manipulated research on glyphosate in order to obscure any connection between cancer and glyphosate. The attorneys allege that their motive in doing so was to protect glyphosate from any inference of cancer because that might hurt Monsanto’s profit margin. At this point it is unclear when Monsanto learned of the potential association of their product and increased risk of cancer.
Those who suffer from the aforementioned cancers and have a qualifying exposure history may hold Monsanto accountable.
Roundup, Glyphosate and Cancer
Monsanto’s Roundup, and the key ingredient, glyphosate, may cause non-Hodgkin’s lymphoma, and attorneys at MCW Law Firm, LLC are currently assisting individuals across the country evaluate their potential claim. Incidences of non-Hodgkin’s lymphoma in the United States have increased on the same time-scale as Monsanto’s takeover of the agricultural industry.
One jury has already determined by clear and convincing evidence that Monsanto knew that their product was carcinogenic -- and that Monsanto told no one.
Despite its reputation, Roundup was by far the most toxic among the herbicides and insecticides tested. This inconsistency between scientific fact and industrial claim may be attributed to huge economic interests, which have been found to falsify health risk assessments and delay health policy decisions.”
R. Mesnage et al., Biomed Research International, Volume 2014, article ID 179691.
Monsanto Roundup Federal Multidistrict Litigation
Currently, the Monsanto lawsuits are composed of individuals that are victims of exposure to glyphosate; the majority of them are agricultural workers, garden center workers, nursery employees, and landscapers. However, many Roundup victims were simply exposed at home or lived on the edges of farms. Glyphosate can be absorbed through the skin, and higher doses of it may result in a higher likelihood of cancer. There is evidence that even a single exposure event may be linked to non-Hodgkin’s lymphoma.
ROUNDUP FEDERAL TRIALS UPDATES
Federal Trials Scheduled to Begin in February 2019
Judge Chhabria, the Federal Judge overseeing the Federal trials, plans to hold the first bellwether trial in San Francisco’s Northern District in early 2019. The mass-district litigation in front of Judge Chhabria will effect hundreds of plaintiff’s that have filed cases in the Federal courts. Importantly, the Court has already ruled in favor of plaintiffs with respect to the science, which allows plaintiffs to present the same evidence the jury ruled on in Dewayne Johnson vs. Monsanto. The outcome of these trials will greatly influence the remainder of the litigation.
Groundbreaking Roundup Verdict – Dewayne Johnson v. Monsanto
Mr. Johnson, the plaintiff, worked as a school groundskeeper for several years before he was diagnosed with non-Hodgkin’s lymphoma. Attorneys for Mr. Johnson, along with attorneys for Monsanto, presented arguments at a jury trial regarding the safety of Roundup. After hearing all the evidence, the jury ruled that his cancer was caused by exposure to Monsanto Roundup.
The trial began on July 9, 2018, and concluded on August 10, 2018, with the jury awarding $289 Million to the plaintiff after determining that Monsanto was responsible for the man's cancer.
State Court Upholds Jury’s Groundbreaking Roundup Verdict
The verdict in Dewayne Johnson vs. Monsanto, entered on August 10, 2018, was upheld by the trial court on October 23, 2018. Although the recent ruling reduced Monsanto’s punitive liability, the jury verdict amounts to $70 million dollars. Monsanto plans to appeal, but faces an uphill battle accordingly to most neutral legal experts.

Roundup Products and Glyphosate
Roundup products vary greatly in the percentage of glyphosate, ranging from around 50% glyphosate in Roundup Pro to 2% in Roundup Ready-to-Use Weed & Grass Killer III. However, the scientific evidence the plaintiff’s have offered suggests that a single exposure event could increase an individual’s chances of being diagnosed with non-Hodgkin’s lymphoma (NHL). Moreover, the minimal exposure threshold an individual can experience before contracting cancer is not yet known.
