August Update: Fourth Bayer (Monsanto) Lawsuit Reaches Trial
After jurors heard weeks of scientific evidence and testimony, three unanimous juries found Bayer's (Monsanto) Roundup causes non-Hodgkin’s lymphoma (NHL). A fourth jury – this time, in the City of St. Louis – is set to decide the same question about NHL and Roundup starting August 19, 2019. The upcoming trial will include the same evidence heard by the first juries. Judge Chhabria, who oversaw the second trial, recently ruled that evidence in that trial “easily supported a conclusion that Monsanto was more concerned with tamping down safety inquiries and manipulating public opinion than it was with ensuring its product is safe.”
Breaking News: Roundup Lawsuit Settlement Possible
Bayer’s CEO and Litigation Board have indicated the company might settle the Roundup cases. Judge’s that heard the first three trials already declined to overturn the verdict and decided that the evidence supported punitive damages. The lawsuits have so far reduced Bayer’s value by billions of dollars. Bayer is reportedly seeking a way to “resolve all Roundup litigation”, in the words of CEO Werner Baumann.

Bayer (Monsanto) Roundup Federal Multidistrict Litigation
Currently, the Bayer (Monsanto) lawsuits are composed of individuals that are victims of exposure to glyphosate; the majority of them are agricultural workers, garden center workers, nursery employees, and landscapers. However, many Roundup victims were simply exposed at home or lived on the edges of farms. Glyphosate can be absorbed through the skin, and higher doses of it may result in a higher likelihood of cancer. Groundbreaking Roundup Verdicts - Update
Pilliod Roundup Lawsuit
The Pilliod trial resulted in a $2 billion jury verdict, with most of the damages coming in punitive damages,which were awarded because the jury found Monsanto's conduct outrageous. Although Judge Smith, the trial judge, reduced the award to $86.7 million, he upheld a large portion of the punitive damages. The Judge found that, “in this case there was clear and convincing evidence that Monsanto made efforts to impede, discourage, or distort scientific inquiry and the resulting science.”
Johnson Roundup Lawsuit
Dewayne Johnson, the first plaintiff to reach trial, is a former school groundskeeper with extremely high Roundup exposure. The jury found that Roundup was a substantial cause of Mr. Johnson's cancer, and awarded him nearly $300 million in damages. Those damages were later reduced to $78 million.
Edward Hardeman Lawsuit
Ed Hardeman, represented by attorney Aimee Wagstaff, was the first Federal trial to reach a jury verdict. Mr. Hardeman was also the first plaintiff to reach trial on a claim of exposure for use of the product at his residence. The jury awarded Mr. Hardeman more than $80 million, which Judge Chhabria later reduced to $25 million. Judge Chhabria found that the evidence supported a conclusion that Monsanto's conduct was "reprehensible" in his decision altering the jury verdict.
